Working time: Workers must be able to postpone paid annual leave on becoming sick
In Asociación Nacional de Grandes Empresas de Distribución (ANGED) v Federación de Asociaciones Sindicales (FASGA) and others, the European Court of Justice (ECJ) held that the Working Time Directive prohibits national measures that do not allow workers who become sick during paid annual leave to take that annual leave at a later time.

Age discrimination: Swedish default retirement age is justified and therefore lawful
In Hörnfeldt v Posten Meddelande AB, the ECJ held that a provision of Swedish law that stipulates that employers may lawfully terminate the contracts of employees who reach the age of 67 does not breach European age discrimination law.

Worker on zero-hours contract placed on short-time working can have holiday pay reduced
The ECJ has confirmed that the holiday pay of a worker on a zero-hours contract placed on short-time working can be calculated on a pro rata basis.

SWITZERLAND EMPLOYMENT LAW GUIDE
The latest addition to XpertHR International is a guide to employment law in Switzerland.

The guide provides a concise summary of the main points of Swiss employment law and covers areas such as employee rights, equal opportunities and termination of employment.

Distinctive features of Swiss employment law include the absence of some family-friendly rights such as statutory paternity and adoption leave, and of specific legislation prohibiting discrimination in employment on grounds other than sex.

In addition, protection against discrimination on grounds other than sex, such as disability, is based on a general statutory duty on employers to protect and respect the "personality" of employees in employment relations.
