The Court of Appeal affirms that an employer's vicarious liability for a violent assault on another employee or third party will depend on whether or not the unlawful act was sufficiently closely connected with the employment.

Redundancy: Capita Hartshead Ltd v Byard
The Employment Appeal Tribunal (EAT) holds that the employer's failure to include in a redundancy selection pool employees doing similar work to the dismissed employee rendered her dismissal for redundancy unfair.

Working time: NHS Leeds v Larner
The Court of Appeal holds that an NHS worker who was absent for the whole leave year and who did not submit any requests for annual leave during her absence was entitled to holiday pay on the termination of her employment.

Redundancy: Welch v Taxi Owners Association (Grangemouth) Ltd
In holding that an employer did not fundamentally breach an employee's contract by failing to make her redundant, the EAT suggests that a redundancy situation will not arise where there is only a diminution in an employer's need for particular work to be carried out, rather than a reduction in the number of employees required to do that work.

Throughout 2012 we have been adding PowerPoint presentations to XpertHR for use alongside the line manager briefings. The latest additions relate to the briefings on disability discrimination and conducting investigations.

The PowerPoint presentations follow the guidance contained in the line manager briefings. Employers can use them to train managers on the workplace issues that they are likely to encounter, helping to ensure that they deal with job applicants and manage workers in accordance with the law and good practice.
