ANNUAL LEAVE FOR SICK EMPLOYEES
European Court of Justice decisions have made it clear that annual leave continues to accrue during sickness absence, and that a worker who has not had the opportunity to take annual leave as a result of sickness absence should be allowed to carry it into the next leave year.
But is a worker who is off sick throughout a leave year required either to give notice of his or her intention to take the annual leave, or specifically to defer it to the next holiday year, if the worker is not to lose the right to be paid for the leave? We report two conflicting Employment Appeal Tribunal decisions on this issue, NHS Leeds v Larner and Fraser v Southwest London St George's Mental Health Trust.
