DISCRIMINATION ARISING FROM DISABILITY
The Equality Act 2010 introduced the concept of discrimination arising from disability. This covers the situation where a disabled person is treated unfavourably, not because of the disability itself but because of something arising in consequence of it, such as the need for periods of absence from work. Although such situations were previously covered by the concept of disability-related discrimination in the Disability Discrimination Act 1995, the 2008 case of London Borough of Lewisham v Malcolm significantly reduced the protection provided.

This week we report two employment tribunal decisions where employees claimed discrimination arising from disability: one where the claimant was successful and the other where the claim failed. Although the decisions are not binding on other tribunals, they provide good illustrations of the situations that may lead to claims of discrimination arising from disability, and how the tribunals are dealing with them. We also discuss the cases in this week's podcast.
